Warwick, RI – Officer Thomas Duncan was on Bald Hill Road at 1:12 a.m. June 14 when a brown Toyota Rav 4 passed him doing 48 mph in a 35 mph zone, then nearly struck a vehicle in the low speed lane before he pulled it over, arresting the driver for DUI.
Duncan identified the driver as Gina K. Delgudice Graham, 47, of 45 Exchange Road, West Warwick, and noted her insurance were expired, according to the officer’s report.
As Duncan spoke with the driver, he could smell a strong odor of alcohol on her breath, he reported. As the woman explained that she had just left the 1500 bar, Duncan also noted he could smell an odor of alcohol on her breath, and her eyes were bloodshot and water.
Duncan administered a series of field sobriety tests, which she failed, with a lack of smooth pursuit in her vision, stopped frequently during the walk-and-turn and put her foot down multiple times during the one-leg-stand.
Duncan arrested Delgudice Graham and transported her to Warwick Police headquarters at 99 Veterans Memorial Drive, where she refused to submit to a chemical test. She was charged with DUI, first offense, blood alcohol content unknown. She was also cited for laned roadway violations, speeding, failing to use a turn signal, laned roadway violations, and operating without evidence of insurance.
