WARWICK, RI — A man nearly struck by a white pickup called Warwick Police to West Shore Road Feb. 26 at 1:28 a.m., where they arrested a West Warwick man on a DUI charge.

Police report the reporting driver said the white GMC had pulled into the lot at Bank of America at 50 West Shore Road, and that the driver was staggering about trying to inspect a tire.
When officers arrived, they found the truck parked at an angle, not in one of the spots, its engine running and a man, later identified as Raymond Bagley, 25, of 12 Green St., West Warwick, according to officer Nia Pina’s report.
Pina approached the man, and quickly smelled a strong odor of alcohol coming from Bagley, according to the officer’s report. When asked why he was out of the truck, Bagley said he wasn’t driving and that his friend, who had just ran away from the truck, had been driving.
When asked how much he’d drank that night, Bagley replied, “A few. I’m feeling good but I was not driving,” according to Pina’s report. When asked to perform sobriety tests, Bagley refused, because, he said, he had not been driving.
Pina arrested Bagley on suspicion of driving under the influence of alcohol, and transported him to Warwick Police Headquarters, 99 Veterans Memorial Drive, Warwick, where he also refused a breath test of his blood alcohol content.
An attempt was made to reach the original reporting party to double check Bagley’s account of events, but the caller could not be reached.
Pina charged Bagley with refusing to submit to a breath test and with DUI, first offense. His truck was towed from the scene by Christian Towing.
