Kenneth Cunningham, 39, who had also been a fugitive from justice for violating parole from a California murder charge, was scheduled for a felony screening on Sept. 15 in Kent County Superior Court. No information on the latest hearing had been posted on the Rhode Island Court Connect website at the time this article was published.
According to Warwick Police, officers chased Cunningham in cars and on foot before he took several shots at three officers who held fire until after Cunningham missed.
In a hearing on Aug. 25, the fugitive-from-justice charge filed by Warwick Police was dismissed. Cunningham was ordered held without bail on three charges filed separately — felony assault, possession of a firearm by a fugitive during a violent crime, and discharging a gun in a violent crime.
Warwick Police reported that two local officers saw Cunningham driving through Oakland Beach at about 12:30 p.m. on Aug. 18. When the officers checked the registration plates on the car, they discovered that Cunningham was wanted for violating parole in California on the attempted murder conviction.
Cunningham led officers on a car chase on West Shore Road to the Lockwood Condominiums, where police say he used his car to ram a police cruiser and then ran away on foot, leading officers to the parking lot of the Crow’s Nest Restaurant, where the shootout happened.
