Officer Stops, Arrests Driver for Marijuana Possession, Dealing

WARWICK, RI  — Officer David Boardman was driving south on Post Road July 29 at 5:52 p.m. when a gray 2013 Honda Accord doing 49 mph in the 35 mph zone bearing a tinted license plate cover, pulling it over and arresting the driver for possession of four ounces of marijuana.

Boardman pulled the Accord over in front the National Guard Building on Airport Road, identifying the driver as Joaquin M. Fabian, Jr., 21, of 106 Dante St., Apt. 2, Providence, according to the officer’s report.

Boardman noted a strong odor of marijuana immediately, and asked Fabian if he had any marijuana in the car, to which he replied yes, indicating two small bags in the driver’s side door panel. Boardman reported that the bags contained marijuana, according to the report.

The officer asked if Fabian had a medical marijuana card, which he did not. Boardman asked him to step from the car and searched him and the vehicle, finding $56 on Fabian’s person and two more bags of marijuana in the car, as well as $200 in cash in the center console. Boardman also found a THC vapor pen and two HTC cartridges for it.

Boardman arrested Fabian and transported him to Warwick Police headquarters, where he was charged with possession of marijuana with intent to distribute. He was also cited for speeding and a display of plate violation.
