Grand Jury Indicts Driver for Striking, Killing Main Avenue Pedestrian

WARWICK, RI — The Kent County Grand Jury reported an indictment charging Marshall Howard, 24, of 88 Asylum Road, Warwick, RI, with one count of DUI death resulting and two counts of possession of a controlled substance Tuesday.

The indictment alleges that on or about May 23, 2017, Howard was operating a car while under the influence of marijuana when he struck and killed David Bustin, 23, originally from Pembroke, MA, a resident of 648 Main Ave., Warwick.

Bustin had been walking across Main Avenue at the time Howard struck him with his car. He was transported to RI Hospital with critical injuries, where he was later pronounced dead.

In addition to the indictment, the Office of Attorney General today charged Howard with one count of breaking and entering and one count of simple assault in an unrelated incident that took place on Aug. 4.

The Warwick Police Department conducted both investigations.  Howard is scheduled to be arraigned in Kent County Superior Court on Sept. 29.
