WARWICK, RI — A North Kingstown man faces felony assault charges in Third District Court April 22 after attacking a man and woman in a Collins Avenue assault Jan. 6, according to WPD records.

Police responded to 19 Collins Ave. that night at 9:30 p.m. for a reported assault in progress inside the house. Initial reports indicated the attacker was using a baseball bat, but officers later determined it was a dowel, according to the report of Officer Gian Micheletti.

When Micheletti arrived, he found two men exiting the house, and ordered them to lay on the ground for a search, which turned up no weapons. One of the men explained that guests at his home, the man with him and a woman, had been assaulted by his friend, John Elliot, 35, of 156 Bethany Ln., North Kingstown.

He said he had invited the pair to stay at his home instead of staying at a hotel, to pay a debt to the man. They agreed to stay, and he and the man occupied the downstairs bathroom to take drugs. When the woman went upstairs to use the bathroom,  she called out, saying, “Help, he is trying to kill me.” The male guest ran upstairs to help, according to the report.

According to the guest’s account, he found the second floor bathroom and bedroom doors closed, and the woman shouted that there was someone else in the house with them. A man in a ski mask wielding a wooden dowel exited the bedroom and struck at the guest with the dowel, which the man blocked by crossing his arms above his head, injuring his arms. The guest and the assailant struggled, tumbling down the stairs together, according to the report.

In the struggle, the guest pulled the attacker’s ski mask off, and recognized him as Elliott, according to the report. The man also managed to gain control of the dowel and punched Elliott in the face, according to Micheletti’s report.

At this point, the woman came down the stairs and ran outside to her car, fleeing the area. Elliott showed a pocket knife to the male guest, and then also fled the house. Officer Keara Enos located and arrested Elliott on Ives Road.

A search of the house turned up the wooden dowel and .3 grams of suspected Fentanyl, according to the report.

Elliott was transported to Rhode Island Hospital for treatment of his injuries and released into WPD custody Jan. 7. Micheletti charged him with two counts of felony assault, and one count of disorderly conduct. Elliott was arraigned on the charges Jan. 8 and scheduled for a court screening on April 22 in Third District Court.
