Athaide asked him to perform sobriety tests, which he consented to. During the tests, he held his head in one hand to steady it during a test of his vision, and demonstrated a lack of smooth pursuit and involuntary eye movement. He also missed heel-to-toe steps and miscounted the steps during a walk and turn test put his foot down, swayed and used his arms for balance during a one-leg stand.
Athaide arrested Quigley on suspicion of DUI and transported him to Warwick Police Headquarters, 99 Veterans Memorial Drive, where he refused a breath test of his blood alcohol level. She released Quigley to a sober adult with a Third District Court summons on Feb. 6 for DUI, blood alcohol unknown, first offense.
