WARWICK, RI — A Warwick man began a pretrial conference today in Third District Court on an assault charge for throwing rocks at his Richmond Avenue neighbor May 22.

Robert Bracken, 66, of 14 George Circle, Warwick, RI, was scheduled to appear in court for pretrial conference on the charge at 9 a.m. July 15.

At 7:36 p.m. May 22, WPD Officer Joseph DiIorio was called to 247 Richmond Ave. for a property dispute, according to the officer’s report. He met with the victim, a 61-year-old woman, who said she had been struck by small rocks thrown by her neighbor, “Bob,” as she weed-wacked the rear of her yard.

As she was trimming weeds, she said, Bracken came out of his house and accused her of trespassing on his property. She said he began throwing rocks at her.

DiIorio noted there were several rocks in the woman’s yard that appeared to have come from Bracken’s property, and also noted a mark on the woman’s arm where she was struck by one of the thrown rocks.

DiIorio spoke with Bracken, who admitted to yelling at his neighbor to get out of  his  yard, but denied throwing rocks at her. Their other neighbors backed up the woman’s story.

One neighbor reported hearing Bracken yelling, then seeing Bracken yelling and throwing rocks at the neighbor, who was dodging the rocks. The victim’s wife also reported seeing Bracken throwing rocks at her.

DiIorio arrested Bracken and charged him with simple assault. He transported him to Warwick Police Headquarters, 99 Veterans Memorial Drive, where he was processed and scheduled for a June 20 arraignment on the charge in Third District Court. On that date he was arraigned and released on $1,000 personal recognizance, with a no-contact order for the victim.
