Bemis reported the Lexus was going fast on the Boulevard before turning right onto Kilvert without stopping at the stop sign. He recorded the license plate and watched the car nearly go off the road, veering into the westbound lanes as it headed east on Kilvert. The Lexus continued in the wrong lane for about a hundred feet before Bemis caught up to it, and pulled the driver over, according to the officers’s report.
Bemis identified the driver as Jude Bain, 53, of 32 Henderson St., Arlington, MA, and noted the man’s speech was slurred, and that his breath smelled of alcohol. He also did not appear to know where he was when asked. Bemis radioed for assistance.
Officer Nicholas Allen arrived at their location on Golden Grove Way and the officers ran Bain through a series of sobriety tests. Allen also noted the odor of alcohol and slurred speech, as well as Bain’s bloodshot eyes, according to the report.
During the tests, Bain was unable to follow instructions for the vision test. He swayed and stumbled during the walk and turn test, and hopped, put his foot down and used his arms for balance during the one-leg stand test, which Allen halted out of concern for Bain’s safety.
Allen arrested Bain on suspicion of DUI, and transported him to Warwick Police Headquarters, 99 Veterans Memorial Drive, where he argued the consent form for a breath test of his blood alcohol had not been read to him, although it had and he had also been allowed to read it, and refused to sign the form, preventing a breath test from being taken.
Bain was charged with DUI, first offense, blood alcohol unknown, and scheduled for a hearing in Third District Court with $1,000 personal recognizance. He was arraigned on the charges Nov. 20 and scheduled for a pretrial hearing Jan. 12, then released on $1,000 personal recognizance again.
