Driver Refuses Tests, Arrested on DUI Charge

WARWICK, RI — The driver of a slow-moving gray RAV-4 crossing into the other lane near 1556 Post Road July 18 at 1:40 a.m. told officers he had drank, “enough to get arrested,” for DUI, a statement on which they all concurred.

Officer Frank Montanaro was driving north past the Cumberland Farms on Post Road early that morning when he saw the SUV crossing into the second lane,  and pulled over the driver, identifying him as Antone Marciano, 47, of 167 Judson Ave., Bristol, CT. Montonaro noted Marciano’s speech was slurred and his eyes appeared, “glassy,” according to the officer’s report. Montonaro called for assistance with the stop, which he suspected concerned a DUI.

Montonaro saw Marciano had bloodied knuckles and asked him about how he’d injured them. Marciano told him he’d punched someone in a bar while defending his passenger. That person, a woman, told Montonaro they’d been at Grid Iron and left after the fight. Montanaro asked Marciano to get out of the SUV.

Officer Ryan Riecke responded to Montanaro’s call and found Marciano sitting on the curb and spoke with him, asking if he’d been drinking. Marciano said he had. As they spoke, Riecke noted an odor of alcohol coming from the driver, according to his report. When asked if he would take sobriety tests, Marciano refused, telling him he’d drunk, “Enough to get arrested,” according to Montanaro’s report.

The officers arranged for the passenger to be driven to her destination, and arrested Marciano on suspicion of DUI, and Riecke transported Marciano to Warwick Police Headquarters, 99 Veterans Memorial Drive, where he was cited for lane violations, and refusing a breath test, and charged with DUI, blood alcohol content unknown.
