Driver Ditched SUV at Dealership, Charged for DUI

WARWICK, RI —  WPD officers were called to Balise Toyota at 1400 Post Road April 5 at 2:19 a.m. for an erratically driven gray Subaru Forrester in the lot, charging the ditched SUV driver for DUI.

Officers Robert Macera and Frank Matarese met with the dealership’s security guard, who said the Subaru had last been seen driving toward the rear of the building and hadn’t reappeared. Macera headed toward the rear of the lot to look for the SUV. A short time later, Matarese radioed him that he’d detained a man outside the front of the dealership.

The officers identified the man as Benjamin Gibson, 41, of 10002 Inwood Dr., Woburn, MA, and asked him where he was coming from, which he didn’t answer. He told the officers he was tired and wanted to sleep. When asked if he knew where he was, the man said he was in Massachusetts. He also said he had been coming from “The Graduate” bar in Providence, where he had had two IPA beers, according to Macera’s report.

The security guard identified Gibson as the man who had driven the Subaru into the lot, according to Matarese’s report. Matarese found a keyfob while searching him, which he later matched to the Forrester, found on the south end of the lot, by using it to lock the doors. City Towing was called to take the SUV off the lot.

Macera asked Gibson to take sobriety tests, which he agreed to, demonstrating a lack of smooth pursuit and involuntary movement in his vision, made an improper turn during the walk and turn test, then put his foot down early multiple times and hopped during a one-leg stand test.

Macera asked Gibson to take a portable breath test, which he also agreed to, registering a .219 blood alcohol content reading on the device. Macera transported Gibson to Warwick Police Headquarters, 99 Veterans Memorial Drive, Warwick, where he refused to take another breath test.

Macera charged him with DUI, blood alcohol unknown, and scheduled him for a Third District Court date on Apri 5, and cited him for refusing the test.
